Sunshine Lottery No 4 (the Lottery) is being conducted by Queensland Police Citizens Youth Welfare Association trading as (PCYC Queensland). In conducting the Lottery, lottery services are provided to PCYC Queensland by TMS Global Services Pty Ltd CAN 089 771 835 (TMS ) trading as Jumbo Fundraising (Jumbo) located at 2/601 Coronation Drive, Toowong , Queensland 4066. Tickets To enter and win the Lottery, entrants must purchase one or more tickets from the Lottery Website or through direct marketing channels as may be used by the Lottery Manager from time to time. Ticket pricing structure is: • 1 for $5 each • 5 for $20; • 10 for $30; • 20 for $50; • 30 for $60and $2 each thereafter. Single ticket pricing $5 plus bundling. One ticket is the minimum requirement for entry in the Lottery, there is no maximum requirement. Lottery Prize It is the responsibility of all entrants of the Lottery to ensure, and Lottery entrants warrant that, they are eligible under all applicable laws to enter the Lottery and accept the prizes offered as a part of the Lottery. Entrants agree to the publication of their ticket number, suburb, state and postcode in the event of a winning ticket. The total Lottery prize pool package is $100,000 comprising of prize pool detailed below. An additional $10,000 in cash is payable to the winner if the winner is a VIP entrant. In the event a prize is not available at the time of the draw, the Lottery Manager reserves the right to issue a replacement prize of similar type and value. All taxes and liabilities associated with the Lottery prize are the responsibility of the winning entrant. All costs expenses, taxes levies and imposts associated with the Lottery prizes not specifically referred to in these terms and conditions as being the responsibility of the Lottery Manager are the responsibility of the winner. Motor vehicle prize conditions Indicated prices for motor vehicle prizes include inclusions to drive away and delivery up $1,000 including GST within Queensland. Prices are based on recommended retail value that are correct at the time of printing and may be subject to change. Any winner of a motor vehicle must receive the prize in Queensland. The Lottery Manager will use its reasonable endeavours to provide the winning entrant with the prize for which they are eligible and elected from the options above. VIP Winning Entrant A VIP winning entrant is a winning entrant who is a current PCYC Queensland VIP Club Member with paid and processed tickets in the Lottery. PCYC Queensland VIP Club Members are PCYC Queensland Supporters with an active (i.e. not paused or cancelled or declined) VIP membership (autoplay) for an ongoing order of five (5) or more tickets automatically in every Lottery (via Credit Card or Direct Debit, excluding ticket purchases made through agents, listed under Agents) or who pay in advance for three (3) or more consecutive Lotteries (via Credit Card, Cheque or Money Order). Prize claim date
The winner has 12 months from the date they are notified using contact details provided to claim the prize.
Unclaimed Prizes
If the prize is not claimed by the prize claim date, the Lottery Manager reserves the right to sell the prize in accordance with the relevant regulatory authority requirements.
Disputes Complaints may be made in person or in writing by emailing customer support [email protected] or calling (07) 3065 9128 All complaints received will have the details recorded. Fair and genuine consideration will be given to any complaint. Complaints will be investigated (and where appropriate relevant staff will be consulted) within a reasonable time frame which will take into account the complexity of the complaint. We will keep complainants and if applicable the person about whom complaint was made, informed of progress and for written complaints. TMS Global Services will treat information with respect and will handle personal information in line with the privacy policy available here. Privacy Statement PCYC Queensland understands and respects a person’s right to privacy. PCYC Queensland may collect an entrant’s personal information for fundraising activities or initiatives. PCYC Queensland may disclose that information to third party organisations to assist PCYC Queensland to facilitate its fundraising activities or initiatives. The Lottery Manager reserves the right, in its sole discretion, to recover damages or other compensation it may deem sufficient in the event that an individual breaches these terms and conditions. The Lottery winner: • agrees to participate in Sunshine Lottery and PCYC Queensland promotional activities which may include, but is not limited to, being filmed, photographed, interviewed and recorded by the Lottery Manager (the Media) and • grants exclusive rights to use the Media to PCYC Queensland and • consents to the supply of the Media by PCYC Queensland to third parties for the promotion of Sunshine Lottery. The Lottery winner is not entitled to a fee or other compensation for use of the Media or partaking in these activities. By entering the Lottery an entrant is consenting to receive communications, including emails, from the Lottery Manager and its authorised marketing partners from time to time. The entrant can ask at any time to be removed from such a communication protocol by requesting their removal from the Lottery Manager via email at [email protected] If the lottery is unable to be conducted If for any reason, in the opinion of the Lottery Manager the Lottery is unable to be undertaken as intended, the Lottery Manager reserves the right to cancel, modify or suspend the Lottery subject to relevant regulatory authority requirements. Limitation of Liability To the extent permitted by law, the Lottery Manager, its related entities, directors, officers, and employees (together Associates) are not liable for any loss or damage of whatsoever nature howsoever occasioned to any person by, through or in connection with the Lottery (including but not limited to direct indirect or consequential loss or damage or personal injury). The Lottery Manager and its Associates are not liable to a winner for the financial consequences (including but not limited to any taxation liability or levy that may accrue to the winner, impact upon eligibility for or receipt of any pension, benefit allowance, superannuation, or similar entitlement) to the winner arising from winning the Lottery prize. Notwithstanding the above, in the event the Lottery Manager or its Associates are found to be liable in connection with the Lottery, their maximum aggregate liability is limited to $100.
